Becoming — Terms of Use

These terms are between you and Otherdays Studio (“we”, “us”), the maker of Becoming. Otherdays Studio is the trading name of Lovish Saini, a sole trader based in the United Kingdom, at 1 Brick Kiln Road, Manchester, M12 5XL. They apply to the Becoming app for iPhone and to everything in it. By using Becoming you agree to them. If you do not agree, do not use the app.
Becoming is distributed through Apple’s App Store, and your licence to use it is Apple’s Licensed Application End User Licence Agreement. These terms add to that agreement; where the two differ, Apple’s agreement governs the licence and these terms govern everything else. Nothing here takes away rights you have as a consumer under the law where you live.
1. Who can use Becoming
You must be 18 or older. Becoming is rated 18+ on the App Store, its subject matter is adult, and some decks ask your date of birth before they open. Do not use the app if you are under 18, and do not let anyone under 18 use it on your phone.
2. Your licence
Under Apple’s agreement you have a personal, non-transferable licence to use Becoming on Apple devices you own or control. You may not copy, sell, rent, lend, or reverse-engineer the app, or extract the question decks from it, except where the law allows you to.
3. Our content
The questions, decks, stories, artwork, names and design of Becoming are ours or our licensors’, and are protected by copyright and other intellectual property law. You may use them inside the app and read them aloud to whoever is in the room. You may not publish, reproduce or sell the decks, in whole or in part, or build another product from them.
4. Your words
Everything said in a night is transcribed and stored on your phone. It stays there. We never receive it, never see it, and claim no rights over it. It is yours. If you keep an encrypted copy (Settings → Keep a copy), that copy and its key are yours, held under your iCloud Keychain, and we cannot open it. The Privacy Policy says exactly what does and does not leave your phone.
5. Your account
You can use Becoming without an account. If you sign in, it is with Sign in with Apple, and we hold only what the Privacy Policy describes. You are responsible for keeping your Apple Account secure. You can delete your account at any time (Settings → Delete account). That permanently deletes your account with us and erases every night, word and person from your phone. There is no undo.
6. Purchases, subscriptions and keys
Sold by Apple. Every purchase in Becoming is made through Apple’s App Store, charged to your Apple Account, and governed by Apple’s terms. We never receive your payment details. Prices are shown in the app before you buy and may vary by country.
Subscriptions. Becoming Plus is a subscription, monthly or yearly. It renews automatically at the end of each period at the price shown when you subscribed, unless you cancel at least 24 hours before the period ends. You manage and cancel it in your iPhone’s Settings, under your name → Subscriptions, not in the app. Cancelling stops the next renewal; you keep Plus until the end of the period you have paid for. If we change the price of a subscription, Apple will tell you first and, where the law requires, ask you to agree before the new price applies.
Lifetime. Plus Lifetime is a single payment for Plus for as long as Becoming is available on the App Store. It is not a subscription and does not renew.
Keys. Keys are bought one or three at a time and spent inside the app to unlock a deck. A key has no cash value, cannot be transferred, exchanged or sold, and is not refundable by us once spent. Keys you hold and decks you have unlocked are kept in your iCloud Keychain so they survive a reinstall and follow you to a new phone. Deleting your account also removes the keys you hold and the decks they opened; purchases made from Apple remain restorable through Apple.
Restore. Restore purchases (Settings → Restore purchases) asks Apple to bring back what your Apple Account has bought. It cannot restore keys already spent.
Refunds. Refunds are handled by Apple under Apple’s terms and your local consumer law. Ask through Apple’s report a problem page. We cannot issue refunds ourselves.
7. Feedback
If you write us a note or answer a survey in the app, you give us permission to keep it, read it, share it within our team, and use it to understand and improve Becoming. We will not publish it with your name without asking you.
8. What Becoming is, and is not
Becoming is a conversation game. It offers questions; it does not give advice. Nothing in it is therapy, counselling, medical, legal or relationship advice, and it is not a substitute for any of those. Transcription can mishear, and a transcript is not a record you should rely on for anything that matters. You decide what to ask, what to answer, and who to play with, and you are responsible for how you use what is said.
9. Acceptable use
Do not use Becoming to harass, threaten or harm anyone, to record anyone who has not agreed to be recorded, or in any way that breaks the law where you are. Recording someone without their knowledge may be illegal where you live; the app asks everyone in the room to agree out loud before it listens, and that is for their protection and yours.
10. Apple’s part
Apple is not a party to these terms and is not responsible for the app or for supporting it. Transcription runs on models supplied by Apple and by the model’s authors, on your device, under their terms. Sign-in, purchases and crash reporting run through Apple’s own systems under Apple’s terms. If Becoming fails to meet a warranty that applies to it, you may tell Apple and Apple may refund the price you paid; Apple has no other warranty obligation for the app. Apple and its subsidiaries may enforce these terms against you as a third-party beneficiary.
11. Our liability
If we fail to meet these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our failure or of our not using reasonable care and skill. We are not responsible for loss that was not foreseeable, for loss caused by something outside our reasonable control, or for business losses, since Becoming is for personal use.
We do not exclude or limit our liability where it would be unlawful to do so, including for death or personal injury caused by our negligence, for fraud, or for your rights under consumer law. If you live in the UK, that includes your right under the Consumer Rights Act 2015 to digital content that is of satisfactory quality, fit for purpose and as described, and to a repair, replacement or refund if it is not.
Beyond that, and to the fullest extent the law allows, Becoming is provided as it is, and our total liability to you for everything arising from your use of it is limited to the amount you paid us for it in the twelve months before the claim.
12. Availability and changes
We may add, change or remove decks and features, and we may stop offering Becoming altogether. Where a change would take away something you have paid for, we will give you reasonable notice, and if you have an active subscription you may cancel it. We may update these terms; the current version is always at this address with its effective date. If a change materially affects you we will tell you in the app before it applies, and continuing to use Becoming after that is your acceptance of it.
13. Ending this agreement
You can end it at any time by deleting the app or your account. We may end it, or suspend your access, if you seriously break these terms, and we will tell you why unless the law prevents us. Sections 3, 4, 7, 8, 11 and 14 survive the end of this agreement.
14. Law and disputes
These terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction, without affecting any consumer rights or protections you have where you live. If you live elsewhere in the UK or in the European Union you may also bring a claim in the courts where you live. If something goes wrong, write to us first; most things can be sorted out in a message.
